How can non-Muslim expats draw up a will in Dubai?
In the UAE, a non-Muslim may apply the provisions of the UAE Personal Status Law for non-Muslims his or her personal matters. This is in accordance with Article 1(1) of the UAE Personal Status Law for non-Muslims, which states:
“The provisions of this Decree Law shall apply to non-Muslims who are national citizens of the United Arab Emirates, and to non-Muslim foreigners residing in the state, unless any of them adheres to the application of the law of their home country, with regards to the articles of marriage, divorce, inheritance, wills, and proof of parentage, without prejudice to the provisions of Articles (12), (13), (15), (16), and (17) of Federal Law No. 5 of 1985 referred to above.”

The provisions of Federal Decree Law No. 33 of 2021 on the Regulation of Employment Relations (the ‘Employment Law’), Ministerial Decree No. 46 of 2022 regarding Work Permits, Job Offers and Employment Contracts Forms (the ‘Ministerial Resolution No. 46 o 2022’) and Administrative Resolution No. 38 of 2022 Concerning the Guidelines for Implementing Ministerial Resolution No. 46 of 2022 Regarding Work Permits, Offer Letters and Employment Contract Forms (the ‘Administrative Resolution No 38 of 2022’) are applicable.
In the UAE, an employer, while recruiting a prospective employee or a current employee in a new role upon resignation, needs to issue an offer letter that mentions the terms and conditions of the employment. Thereafter, the same terms and conditions should be mentioned in the employment contract of an employee. This is in accordance with Article 2(1) of the Ministerial Decree No. 46 of 2022.
